Welcome to GoWhiteMountains.org, the organizational website of Go White Mountains Inc. (“Go White Mountains,” “GWM,” “we,” “us,” or “our”).
These Terms of Use (“Terms”) govern your access to and use of GoWhiteMountains.org and the pages, information, materials, resources, forms, features, and services made available through the website (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.
1. About Go White Mountains Inc.
Go White Mountains Inc. is a nonprofit organization dedicated to promoting, educating, connecting, and supporting Arizona’s White Mountains region.
Our activities may include destination marketing, visitor education and information, regional promotion, community and business collaboration, partnerships, cooperative marketing, shared resources, and other initiatives intended to strengthen the communities, businesses, organizations, visitor economy, and quality of experience within the White Mountains region.
GoWhiteMountains.org serves as the organizational website of Go White Mountains Inc.
Go White Mountains Inc. also utilizes GoWhiteMountains.com as a regional destination marketing, travel, recreation, event, and visitor-information platform pursuant to a license from Peak Dynamics LLC, the owner of GoWhiteMountains.com and associated proprietary rights.
GoWhiteMountains.org and GoWhiteMountains.com serve related but distinct purposes and may be subject to separate Terms of Use, Privacy Policies, advertising agreements, submission requirements, partnership agreements, licensing agreements, and other policies or terms.
2. GoWhiteMountains.com and Licensed Technology
GoWhiteMountains.com is owned by Peak Dynamics LLC and is licensed for use by Go White Mountains Inc.
The licensing, operation, promotion, or use of GoWhiteMountains.com by or for Go White Mountains Inc. does not transfer ownership of the GoWhiteMountains.com domain name or any software, website architecture, technology, databases, proprietary systems, designs, intellectual property, or other assets owned by Peak Dynamics LLC unless expressly provided otherwise in a written agreement.
Go White Mountains Inc. may utilize GoWhiteMountains.com in furtherance of its nonprofit mission and regional activities, including destination marketing, visitor information, community promotion, regional collaboration, business promotion, events, outdoor recreation information, advertising, sponsorships, cooperative marketing, and related activities, subject to the applicable licensing agreement.
Nothing contained on GoWhiteMountains.org or GoWhiteMountains.com shall be interpreted as transferring ownership of Peak Dynamics LLC intellectual property to Go White Mountains Inc. or to any participating business, municipality, community, sponsor, partner, member, contributor, advertiser, organization, or other third party.
The ownership and licensing relationship concerning GoWhiteMountains.com is governed by a separate agreement between Peak Dynamics LLC and Go White Mountains Inc.
3. Informational Purposes
Information provided through the Site is offered for general informational, educational, promotional, and community-development purposes.
We make reasonable efforts to provide useful and accurate information. However, information concerning businesses, organizations, communities, attractions, events, outdoor recreation, public lands, roads, trails, weather, operating hours, fees, regulations, closures, conditions, availability, and similar matters can change without notice.
We do not guarantee that information appearing on the Site is complete, current, accurate, or suitable for any particular purpose.
Before traveling, attending an event, entering public or private lands, participating in outdoor recreation, purchasing products or services, or making decisions based upon information found through the Site, you should verify important information directly with the appropriate business, event organizer, land manager, government agency, property owner, service provider, or other responsible source.
4. Outdoor Recreation and Travel
Arizona’s White Mountains offer opportunities for hiking, fishing, camping, boating, paddling, cycling, mountain biking, horseback riding, off-highway vehicle use, skiing, snow recreation, hunting, wildlife viewing, sightseeing, and many other outdoor activities.
Outdoor recreation and travel involve inherent risks.
Conditions may change rapidly because of weather, wildfire, flooding, snow, ice, lightning, road conditions, trail conditions, wildlife, terrain, elevation, falling trees, water conditions, forest closures, emergency restrictions, construction, or other circumstances.
Information provided through the Site should not be considered a substitute for your own judgment, preparation, appropriate equipment, knowledge, experience, or current information from applicable land-management, transportation, weather, or public-safety authorities.
You are responsible for determining whether an activity, destination, route, trail, road, lake, campground, attraction, or other location is appropriate and safe for you and members of your party.
Go White Mountains Inc. does not assume responsibility for accidents, injuries, illness, death, property damage, travel disruptions, closures, changing conditions, or other losses associated with travel or recreational activities described, referenced, linked to, or promoted through the Site.
5. Emergency and Official Information
The Site is not an emergency notification service.
Do not rely upon the Site for emergency warnings, evacuation instructions, wildfire information, road closures, weather warnings, search-and-rescue information, public-safety notices, or other time-sensitive official information.
For emergencies, contact the appropriate emergency services.
For current restrictions, closures, warnings, permits, regulations, fire restrictions, road conditions, weather conditions, and other official information, consult the responsible federal, state, tribal, county, municipal, or local authority.
6. Third-Party Information
Some information appearing on the Site may be provided by or derived from businesses, tourism organizations, chambers of commerce, nonprofit organizations, municipalities, tribal entities, government agencies, event organizers, land managers, community organizations, contributors, sponsors, partners, or other third parties.
Although Go White Mountains Inc. may review, organize, edit, format, summarize, or publish such information, we do not independently verify every statement or representation supplied by third parties.
The inclusion of information concerning a business, organization, community, event, attraction, destination, product, service, property, or activity does not constitute a guarantee regarding its quality, safety, availability, accuracy, legality, accessibility, or suitability.
7. Events and Event Information
The Site may provide information concerning festivals, concerts, sporting events, community activities, markets, meetings, recreational events, educational programs, and other activities.
Unless expressly stated otherwise, Go White Mountains Inc. is not the producer, operator, sponsor, owner, or organizer of an event merely because the event appears on or is promoted through the Site.
Event dates, times, locations, admission requirements, prices, schedules, performers, activities, availability, and cancellation policies may change without notice.
Users should confirm important event information directly with the event organizer before traveling, making reservations, purchasing tickets, or otherwise relying upon information appearing on the Site.
Event organizers are responsible for the accuracy of information they provide and for the operation, safety, legality, accessibility, licensing, insurance, and administration of their events.
8. Businesses, Organizations, Communities, and Listings
Go White Mountains Inc. may identify, feature, describe, list, link to, or promote businesses, communities, municipalities, attractions, accommodations, restaurants, retailers, organizations, recreational providers, and other entities serving or associated with Arizona’s White Mountains.
Inclusion on the Site does not constitute certification, warranty, recommendation, or endorsement unless expressly stated otherwise.
Businesses and organizations are independently responsible for their products, services, pricing, representations, operations, licensing, insurance, customer service, safety practices, accessibility, and compliance with applicable laws.
Any transaction, reservation, purchase, agreement, dispute, or other relationship between you and a third party is solely between you and that third party.
9. Partnerships, Sponsors, Advertising, and Promotional Relationships
Go White Mountains Inc. may receive financial or in-kind support through donations, contributions, grants, memberships, sponsorships, cooperative marketing programs, advertising, partnerships, promotional arrangements, or other relationships.
We may identify or feature sponsors, partners, participating organizations, advertisers, supporters, communities, or businesses on the Site.
The existence of a financial, sponsorship, advertising, cooperative marketing, or promotional relationship does not constitute a guarantee or warranty of the products, services, activities, or representations of the participating organization.
Where appropriate or required by law, sponsored, paid, or promotional content may be identified as such.

The Site may contain links to third-party websites, social-media platforms, reservation systems, mapping services, government websites, business websites, event pages, payment providers, and other external resources.
The Site may also link to GoWhiteMountains.com, a regional destination marketing and visitor-information platform owned by Peak Dynamics LLC and licensed for use by Go White Mountains Inc.
A link from GoWhiteMountains.org to GoWhiteMountains.com should not be interpreted in the same manner as a link to an ordinary unaffiliated third-party website. However, GoWhiteMountains.com may maintain its own Terms of Use, Privacy Policy, advertising policies, submission requirements, disclaimers, and other terms governing use of that platform.
Other external links are provided for convenience and informational purposes.
Go White Mountains Inc. does not control unaffiliated third-party websites and is not responsible for their availability, security, accessibility, accuracy, content, privacy practices, products, services, representations, or policies.
Your use of unaffiliated third-party websites and services is governed by the terms and policies of those third parties.
11. Maps, Directions, Routes, and Location Information
Maps, geographic coordinates, directions, trail descriptions, driving instructions, route information, mileage, elevation information, access descriptions, and similar materials provided through or linked from the Site are intended as general informational resources.
Roads, trails, access points, property boundaries, gates, signs, routes, and conditions may change.
Some routes or destinations may cross, enter, border, or approach private, tribal, federal, state, county, municipal, or otherwise restricted lands.
You are responsible for determining lawful access, observing posted signs and closures, obtaining required permits, complying with applicable rules, and respecting private property.
Nothing appearing on the Site grants or implies a legal right of access to any property.
Never rely exclusively on information from the Site for backcountry navigation, emergency planning, or personal safety.
12. Responsible Use of the White Mountains
Go White Mountains Inc. encourages residents and visitors to enjoy Arizona’s White Mountains responsibly.
Users should respect private property, public lands, tribal lands, wildlife, cultural resources, historic resources, fire restrictions, environmental protections, public-land regulations, trail rules, local communities, businesses, residents, and other visitors.
Nothing published through the Site authorizes entry onto private property, restricted lands, closed areas, or locations where access would otherwise be unlawful.
Visitors are responsible for knowing and following applicable laws, regulations, permits, restrictions, and posted requirements.
13. Intellectual Property
Unless otherwise indicated, content and materials appearing on GoWhiteMountains.org—including original text, articles, graphics, logos, branding, photographs, video, design elements, publications, databases, compilations, and other materials—may be owned by Go White Mountains Inc., Peak Dynamics LLC, their respective licensors, individual content creators, photographers, writers, participating organizations, governmental entities, or other identified rights holders.
Certain technology, content, designs, systems, intellectual property, and other materials used in connection with Go White Mountains Inc.’s activities may be provided under license from Peak Dynamics LLC or other third parties.
GoWhiteMountains.com, including the domain name and proprietary platform assets associated with it, remains the property of Peak Dynamics LLC and is made available to Go White Mountains Inc. pursuant to license.
Nothing in these Terms transfers ownership of intellectual property belonging to Peak Dynamics LLC, Go White Mountains Inc., photographers, writers, contributors, licensors, businesses, governmental entities, or other rights holders.
Users may access publicly available Site content for personal, noncommercial informational purposes.
Except as permitted by law or authorized by the applicable rights holder, users may not reproduce, republish, distribute, sell, license, commercially exploit, systematically download, scrape, modify, or create derivative works from protected Site content.
Users may link to publicly available pages on the Site provided that the link does not falsely imply sponsorship, endorsement, partnership, authorization, or affiliation.
14. Trademarks, Names, and Branding
Names, logos, trademarks, service marks, slogans, graphics, and branding appearing on the Site may belong to Go White Mountains Inc., Peak Dynamics LLC, participating businesses, municipalities, organizations, sponsors, partners, or other third parties.
Nothing contained on the Site grants a license or right to use any trademark, service mark, trade name, logo, or branding without authorization from the applicable rights holder.
15. Photographs, Videos, and Third-Party Content
Certain photographs, articles, videos, illustrations, trademarks, logos, maps, graphics, or other materials appearing on the Site may belong to photographers, writers, businesses, organizations, agencies, partners, contributors, or other third parties.
Such materials remain subject to the rights of their respective owners.
Permission to view third-party content through the Site does not grant permission to download, reproduce, distribute, publish, commercially use, or otherwise exploit that content.
16. Content Submitted to Go White Mountains
You may have opportunities to submit photographs, text, event information, business information, articles, stories, videos, testimonials, corrections, suggestions, or other materials (“Submitted Content”) to Go White Mountains Inc.
By submitting content, you represent and warrant that you own the content or otherwise possess the rights and permissions necessary to provide it and authorize its use as described below.
You further represent that our authorized use of the Submitted Content will not violate another party’s copyright, trademark, privacy, publicity, contractual, or other rights.
Unless otherwise agreed in writing, by submitting content for publication, promotion, or consideration, you grant Go White Mountains Inc. a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, crop, resize, format, adapt, publish, display, distribute, archive, and promote the Submitted Content in connection with our nonprofit mission, destination marketing, visitor education, regional promotion, websites, social media, email communications, publications, presentations, advertising, cooperative marketing, and promotional activities.
You retain ownership of rights you otherwise hold in your original content.
Submission of content does not obligate Go White Mountains Inc. to publish or use it.
We may edit, decline, remove, replace, or discontinue Submitted Content at our discretion.
Separate agreements may apply to professional contributors, photographers, writers, contractors, advertisers, sponsors, partners, or other parties providing content under a written agreement.
17. Corrections and Updates
We welcome reasonable notifications concerning inaccurate, outdated, or incomplete information appearing on the Site.
However, submission of a correction does not obligate Go White Mountains Inc. to make a requested change.
We reserve the right to determine how information is presented, edited, categorized, described, or removed, subject to applicable law and contractual obligations.
18. Acceptable Use
You agree not to use the Site:
- for unlawful or fraudulent purposes;
- to interfere with the operation, availability, or security of the Site;
- to attempt unauthorized access to the Site, servers, accounts, databases, or systems;

Specific terms associated with a contribution, sponsorship, membership, campaign, grant, partnership, or program may be provided separately and will supplement these Terms where applicable.
Nothing on the Site should be interpreted as tax, legal, accounting, investment, or financial advice.
Donors and contributors should consult their own professional advisors regarding the tax or legal treatment of contributions.
20. No Professional Advice
Information available through the Site is not intended as legal, medical, financial, tax, accounting, investment, engineering, safety, emergency-management, navigation, or other professional advice.
You should consult an appropriate qualified professional, government agency, land manager, or other responsible authority when such advice or authoritative information is required.
21. No Guarantee of Availability
We do not guarantee that the Site or any particular page, service, listing, feature, program, resource, or content will remain continuously available.
The Site may experience interruptions because of maintenance, technical problems, third-party services, internet connectivity, security issues, software changes, or circumstances beyond our control.
22. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ITS CONTENT, INFORMATION, FEATURES, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

23. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GO WHITE MOUNTAINS INC. AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, CONTRACTORS, CONTRIBUTORS, REPRESENTATIVES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO YOUR USE OF, INABILITY TO USE, OR RELIANCE UPON THE SITE OR INFORMATION AVAILABLE THROUGH IT.
THIS INCLUDES, WITHOUT LIMITATION, LOSSES ARISING FROM TRAVEL DECISIONS, RECREATIONAL ACTIVITIES, ROAD OR TRAIL CONDITIONS, WEATHER, NATURAL HAZARDS, BUSINESS TRANSACTIONS, RESERVATIONS, EVENT ATTENDANCE, THIRD-PARTY PRODUCTS OR SERVICES, INACCURATE OR OUTDATED INFORMATION, WEBSITE INTERRUPTIONS, EXTERNAL WEBSITES, OR USER-SUBMITTED INFORMATION.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

These Terms govern use of GoWhiteMountains.org.
They do not modify, supersede, terminate, or create rights under any separate license, services agreement, platform agreement, advertising agreement, sponsorship agreement, cooperative marketing agreement, content agreement, partnership agreement, grant agreement, or other contract between Go White Mountains Inc., Peak Dynamics LLC, or any third party.
The ownership and licensing relationship concerning GoWhiteMountains.com is governed by the applicable written agreement between Peak Dynamics LLC and Go White Mountains Inc.
If a separate written agreement between you and Go White Mountains Inc. applies to a particular activity and directly conflicts with these Terms, the terms of the applicable written agreement will govern that activity to the extent of the conflict.
30. No Partnership or Agency Created by Website Use
Your use of the Site, participation in an event, inclusion in a listing, submission of content, sponsorship, advertising participation, or other interaction with the Site does not by itself create an employment, agency, joint venture, franchise, fiduciary, or legal partnership relationship with Go White Mountains Inc.
Any formal partnership, sponsorship, licensing, advertising, contractor, or other business relationship is governed by the applicable written agreement, if any.
31. Governing Law
These Terms and your use of the Site are governed by the laws of the State of Arizona, without regard to conflict-of-law principles.
To the extent permitted by applicable law, any dispute arising from or relating to these Terms or use of the Site shall be subject to the jurisdiction of the appropriate state or federal courts located in Arizona.
32. Severability
If any provision of these Terms is determined by a court or other authority of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
33. No Waiver
The failure of Go White Mountains Inc. to exercise or enforce any provision of these Terms does not constitute a waiver of that provision or our right to exercise or enforce it later.

Section headings are provided for convenience and organization only and do not limit or otherwise affect the meaning or interpretation of these Terms.
35. Entire Agreement Regarding Website Use
These Terms, together with the Privacy Policy and any additional terms expressly applicable to particular Site features or services, constitute the agreement between you and Go White Mountains Inc. concerning your use of GoWhiteMountains.org.
These Terms do not constitute or replace the licensing agreement between Peak Dynamics LLC and Go White Mountains Inc. concerning GoWhiteMountains.com or any other separately executed agreement.
